La despenalización de la marihuana en Puerto Rico sigue recabando apoyos

San Juan (EFE) – La despenalización en Puerto Rico de la tenencia de marihuana en pequeñas cantidades, así como su consumo con fines medicinales, siguen recabando apoyos durante su debate legislativo, en el que se celebran estos días vistas públicas.
Así, diversas organizaciones sociales se pronunciaron esta semana en la Cámara de Representantes local a favor del proyecto de Ley que pretende despenalizar la tenencia de marihuana en pequeñas cantidades en Puerto Rico.
Las vistas públicas, que continuarán la semana próxima, siguen a la aprobación por parte de la otra cámara legislativa local, el Senado, del proyecto de ley 517 que busca despenalizar el consumo personal de marihuana en Puerto Rico y que establece que la tenencia de hasta 14 gramos de esa sustancia no tenga carácter delictivo.
Una vez finalizadas las vistas, la Cámara de Representantes deberá ratificar o introducir modificaciones al texto y, una vez aprobado, remitirlo al gobernador Alejandro García Padilla para que lo firme y lo convierta en ley.
El proyecto, impulsado por el legislador del gobernante Partido Popular Democrático (PPD) Miguel Pereira, ha generado polémica en la opinión pública local.
Uno de los participantes en las vistas es el psicólogo social y director de la organización Descriminalización.org, Rafi Torruella, quien explicó hoy a Efe por qué apoya esta iniciativa.
“La cárcel no es la solución”, señaló Torruella, para quien es evidente que criminalizar el consumo de la sustancia sólo crea problemas a nivel individual y a nivel social.
El proyecto establece que la tenencia de hasta 14 gramos se considere sólo una infracción, penada con una multa máxima de 100 dólares (200 si se reincide y 300 si son tres veces).
Si la cantidad está entre 14 y 28 gramos se considerará un cargo criminal y podrá castigarse con un máximo de 500 dólares y seis meses de prisión. Si es más se seguirá considerando delito grave y se mantendrán las penas actuales de tres años de prisión obligatoria y multa de hasta 5.000 dólares.
Torruella insistió en que “no todos los consumidores de marihuana son criminales” y que permitir el consumo personal de marihuana debe forma parte del cambio en la política pública de Puerto Rico que propone Descriminalización.org.

Actualmente se están discutiendo tres proyectos de ley para crear una Junta Reguladora de Electricidad en Puerto Rico. El P. del S. 837, presentado por el presidente del Senado; el P. del S. 882 presentado por el Gobernador; y en la Cámara de Representantes se ha radicado el P. de la C. 1457 para lograr objetivos similares. Todos surgen del creciente reclamo público para la creación de un ente externo que fiscalice a la Autoridad de Energía Eléctrica y que regule la industria eléctrica en la Isla.
¿Por qué es necesario crear una Junta Reguladora de Electricidad?
Un regulador robusto e independiente es crucial para asegurar el interés público frente a un ente tan opaco y arbitrario como la Autoridad de Energía Eléctrica y para asegurarle a Puerto Rico todo un abanico de opciones futuras: desde integrar nuevos productores de energía al sistema de la Autoridad de Energía Eléctrica, como se hace al momento, hasta abrir ciertas áreas a competencia. Además, un regulador externo que supervise la Autoridad de Energía Eléctrica obligaría a la agencia a reducir sus costos y a llevar a cabo sus operaciones con mayor eficiencia a largo plazo, en lugar de simplemente aumentar continuamente las tarifas para poder cumplir con el servicio de su deuda y pagar sus otras obligaciones. Finalmente, una junta reguladora permitirá que Puerto Rico pueda encaminar un proceso de planificación energética a largo plazo – algo que la AEE ha sido incapaz de hacer hasta el momento.
¿De todos esos proyectos que se están discutiendo públicamente cuál es el que más beneficia al consumidor y ayuda a que baje la factura de electricidad?
En nuestra opinión, el proyecto presentado por el presidente del Senado es el que más beneficia al consumidor por varias razones. Primero, porque crea una junta reguladora exclusivamente para el sector eléctrico. Los otros dos proyectos ampliarían la jurisdicción de la Junta Reglamentadora de Telecomunicaciones para incluir el sistema eléctrico. Esto no nos parece una buena idea ya que la complejidad del sistema eléctrico exige la atención de un ente regulador que tenga el conocimiento y los recursos necesarios para poder llevar a cabo su misión. La tarea de supervisar y fiscalizar a la industria eléctrica simplemente requiere de un organismo especializado que pueda dedicarse a ella a tiempo completo.
Segundo, el proyecto del Senado le otorga a la Junta Reguladora la autoridad para establecer, revisar, y aprobar las tarifas eléctricas. Mientras que el proyecto del Gobernador no le otorga a la Comisión la capacidad para dirigir el proceso de revisión y establecimiento de tarifas. La Autoridad de Energía Eléctrica seguiría determinando sus tarifas como hasta ahora, y solo vendría obligada a radicar las mismas ante la Comisión. Peor aún, la legislación propuesta por la administración penaliza a las personas que quieran presentar alguna querella o que quieran impugnar alguno de los procedimientos de la Autoridad, ya que le impone al querellante un requisito de prestar una fianza sin un tope o limite fijo. Lejos de fortalecer las protecciones a los consumidores y a los productores independientes, la legislación del Gobernador parece dirigida a desalentar las querellas y limitar el acceso a los ciudadanos.
Finalmente, el proyecto del Senado autoriza a la Junta Reguladora a regular el mercado eléctrico en Puerto Rico y este es el verdadero problema de fondo: la Junta de Gobierno de la AEE, además de gobernar la corporación, también reglamenta el mercado de electricidad en Puerto Rico. Esto resulta en un conflicto de intereses ya que la AEE es juez y parte en la determinación de los términos y condiciones que aplican a quienes buscan conectarse al sistema. El proyecto de la administración no atiende este problema.
¿Por qué es tan difícil reformar a la AEE?
El problema es que diversos grupos de interés, tales como los suplidores, los traficantes de petróleo, los partidos políticos, los beneficiarios de subsidios, los empleados, los bonistas y sus banqueros, y personas con conexiones políticas se han organizado para extraer beneficios de la AEE a costa del resto del pueblo de Puerto Rico. A este entramado de intereses se le ha denominado como el “cartel del petróleo.”
El cartel del petróleo obstaculiza la reestructuración de la AEE ya que cada uno de los grupos que se beneficia del status quo está bien organizado y tiene un interés fuerte en proteger sus beneficios, mientras los consumidores están desorganizados y los costos de la acción colectiva son altos. El problema de fondo, entonces, no es uno tecnológico o financiero sino de economía política, específicamente de balancear los intereses de quienes se benefician del sistema existente y de quienes se ven afectados adversamente por éste.
La AEE, por tanto, necesita un ente externo que le imponga disciplina y que ataje la conducta depredadora de los grupos de interés internos y externos a la corporación que se benefician injustamente de la situación actual. Es por esto que el CNE lleva más de ocho años abogando a favor de la creación de un ente independiente que regule el mercado de electricidad de una manera objetiva y libre de intereses creados, ya sea financieros o políticos. De lo contrario podemos esperar que la AEE continúe utilizando plantas obsoletas; cobrando tarifas excesivamente altas; repartiendo contratos a diestra y siniestra; y negándose arbitrariamente a conectar al sistema a productores más eficientes.
¿Por qué no se puede simplemente romper la AEE en mil pedazos?
No es deseable “implosionar” la AEE, como sugieren algunas de las voces menos ilustradas del sector privado del País, porque eso lo único que lograría sería crear un caos en la economía de la Isla. Contrario al servicio de telecomunicaciones, que se puede proveer a través de un sistema inalámbrico, la electricidad se transmite y distribuye solamente a través de una red de cables. Esa red no tiene una capacidad ilimitada para transmitir carga eléctrica. Sin un control adecuado, el sistema simplemente dejaría de funcionar. Sería como un aeropuerto sin torre de control, imagínese el desastre de tener decenas de aviones tratando de aterrizar y despegar al mismo tiempo sin ningún tipo de control.
¿Cuánto es la deuda que arrastra la AEE? ¿Cuál es el problema con la deuda y por qué se está hablando de eso?
De acuerdo con el Official Statement de la más reciente emisión de bonos de la AEE en agosto de 2013, el principal de la deuda de la AEE sumaba $9,287 millones, incluyendo $8,526 millones en bonos, $744 millones de líneas de crédito y $16 millones de otros prestamos. La AEE alega que la creación de una Junta Reguladora violaría uno de los acuerdos que ésta ha hecho con sus bonistas, específicamente aquel que le requiere cobrar lo suficiente cada año para cubrir (1) los gastos operacionales de la AEE y (2) el 120% del servicio de la deuda pagadera el próximo año fiscal. En nuestra opinión, este es un argumento sin sustancia ya que la Junta Reguladora tomaría en cuenta el servicio de la deuda como uno de los costos fijos de la AEE a la hora de determinar las tarifas. Además, la Junta Reguladora tendría la autoridad legal para forzar a la AEE a reducir sus costos operacionales. Por tanto, sería posible reducir las tarifas a los consumidores y asegurar el repago de la deuda de la AEE con sus bonistas.
En resumen, cualquier Junta Reguladora que se establezca debe tener suficiente autoridad para lograr los siguientes objetivos: (1) equidad tarifaria: que la AEE facture por lo que consumimos sin esconder otros cargos en la factura y que las tarifas sean justas y razonables; (2) mayor eficiencia: exigir y forzar a la AEE a reducir sus costos operacionales y aumentar la confiabilidad del servicio; y (3) regular el mercado eléctrico en Puerto Rico: que la AEE no se vele ella misma, que no tenga el poder de obstaculizar a otros generadores, y que los consumidores cuenten con un foro adecuado para presentar sus reclamos.
Le corresponde a usted amigo lector decidir qué tipo de junta quiere, una que trabaje para usted o una que trabaje para el cartel del petróleo.
