‘Commonwealth’ Party Legislator Sponsors Statehood Plebiscite Bill; Party Split Three Ways on Ballot Question

A ‘Commonwealth’ party member of Puerto Rico’s House of Representatives today introduced a bill to have a plebiscite on statehood in the territory along with the 2016 general elections.
Carlos Vargas formalized the proposal of Governor Alejandro Garcia Padilla’s predecessor as ‘Commonwealth’ party president. Former House Minority Leader Hector Ferrer left public life in 2012 amidst allegations that an investigation later found lacked sufficient evidence but recently said that he might challenge Garcia within their party for the gubernatorial nomination in 2016.
Garcia Padilla’s Secretary General of the ‘Commonwealth’ party, Jorge Suarez, said that the party’s Governing Board will consider Vargas’ proposal at a meeting originally scheduled for today but postponed until a date later this month still to be determined.
Garcia recently proposed that the territory have a plebiscite under a Federal law enacted in January. The law provided for a plebiscite on an option or options that can resolve the questions of Puerto Rico’s ultimate status and are found by the U.S. Department of Justice to not conflict with the Constitution, laws, and policies of the United States.
The Governor proposed that the plebiscite be on multiple options, including a new definition of “Commonwealth” proposed by former Governor Rafael Hernandez Colon that he endorsed. It would interpret rather than change the territory’s status.  The interpretation would claim that, although Puerto Rico remains subject to the broad powers of Congress to govern territories, Congress has given up the powers of all future Congresses to govern Puerto Rico on matters considered within the authority of States.
The proposal would also fund Puerto Rico equally with the States in all Federal social programs  and change the application of tax, trade, ocean freight, airline route laws to the territory.
Other party leaders want the “Commonwealth” option for a plebiscite or Puerto Rico Government status assembly to be a development of the party’s current definition of “Commonwealth.” Under it, Puerto Rico would become a nation but in a permanent arrangement with the U.S. in which the Commonwealth could limit Federal laws and court jurisdiction and enter into international trade and other agreements. At the same time the U.S. would be obligated to continue to provide Puerto Rico with U.S. citizenship, current program benefits for individuals, free entry to goods shipped from Puerto Rico, and a new budgetary subsidy to the local government.
Puerto Rico’s representative to the Federal government and statehood party president, Pedro Pierluisi, initially proposed having the plebiscite on statehood. The Commonwealth’s Resident Commissioner has led 131 other members of the U.S. House of Representatives and three U.S. senators in proposing Federal legislation for a statehood plebiscite.
The bills by Pierluisi and others would require the president of the United States to propose a plan for changing Federal spending and tax laws over a multi-year period to enable Puerto Rico to become a State if Puerto Ricans vote for the status a second time. The legislation would also pledge congressional approval of such a plan.
Puerto Ricans overwhelmingly chose statehood over nationhood in a plebiscite under local law held along with the 2012 elections after rejecting the current territory status, sometimes misleadingly called “Commonwealth” after the official name of the insular government.
Garcia has strongly opposed the statehood plebiscite idea.  He seems to be concerned that a statehood plebiscite would result in a second victory for the status.
Statehood, independence, and nationhood in an association with the U.S. that either nation can end are the possible options for the plebiscite that have significant support in Puerto Rico.
A “Commonwealth” proposal cannot be an option because it either cannot resolve the question of Puerto Rico’s ultimate status or would conflict with the Constitution, laws, and policies of the U.S.
The ‘Commonwealth’ party has made different proposals for an unprecedented political status it calls “Commonwealth” in every decade since the 1950s. Federal officials have rejected each one for U.S. constitutional and other reasons. So, a new “Commonwealth” proposal is unlikely to be found consistent with the Constitution, laws, and policies of the U.S.
The Obama White House, which had supported the 2012 plebiscite and hailed its results, proposed the Federal plebiscite law enacted in January. The White House was concerned that Garcia’s lobbying against Federal action on the local plebiscite’s statehood petition would result in the Congress not acting on Puerto Rico’s self-determination decision. Leaders of both national political parties in Congress agreed.

Monitor Police meets with former governors

The call monitor Police Puerto Rico, Arnaldo Claudio, met in recent days with several former governors of the island, with exsuperintendentes Police and visited and some of the commands in order to familiarize themselves with the functioning of force and their problems.
According to Federal Judge Gustavo Gelpi, who also Claudio held a meeting yesterday, the technical adviser of compliance (TCA, for its acronym in English) of the Police Reform, on the island will soon have the team of experts that will help their work.
"The monitor has met, on my instruction, four former governors," said Gelpí reporters covering the federal court.
The former governors visited by Claudio said the judge, were Rafael Hernández Colón, Carlos Romero Barceló, Luis Fortuño, Aníbal Acevedo Vila. Forward Gelpí that are scheduled or managed and the other two former governors Sila Maria Calderon and Pedro Rosselló meetings.
He explained that the idea is to evaluate what concerns they have and did these former governors on the operation of the police and what recommendations can provide to help correct the problems it faces.
Reminded the judge and Claudio met with the Resident Commissioner Pedro Pierluisi, as well as the chairmen of the House and Senate, Perello and Jaime Eduardo Bhatia.
"It has it met several exsuperintendentes Police and visited the command headquarters to meet with the colonels and will keep doing that," he said.
Gelpí announced that the August 6 is scheduled to visit, along with the monitor, the Police Academy in Gurabo, to understand its functioning.
The team of experts to help in its work Claudio said the judge, come to Puerto Rico during the week of August 12th and will meet with the Gelpí own, with the directors of the Academy of Police and other officials related different areas of police reform.
Claudio, who is a retired Army colonel from the United States and Puerto Rico, was confirmed on June 5 as a technical advisor in charge of ensuring compliance with the reform of the Puerto Rico Police. He was appointed by the federal and state departments of Justice and confirmed by Gelpí.
It serves as an officer of the Federal Court of Puerto Rico, although his salary compensation is paid with funds provided by the Commonwealth.
Police reform was ratified on July 17, 2013, by Governor Alejandro García Padilla and Secretary of Justice of the United States, Eric H. Holder, and is the result of a lawsuit submitted the Department of Justice against Government of Puerto Rico for civil rights violations by the state police force.
The agreement covers four basic areas, which are: retraining, recruitment and effective supervision of agents; interactions that have not discriminatory at the time of the arrests, raids and searches practices; community outreach, meet regularly and address their claims within 90 days; and implement information systems and technology.

This would be a huge, huge gamble on their part.
I don't see any other way out, at least with dignity, for the colonialists.
At least, their party might come out intact, for the soberanistas and "happy colonialists" will be together in their loss.
Remember, the "happy colonialists" are betting on a coalition with soberanistas and independentistas.
And on the other hand, is Agapito's demise or life.....
This sort of plebiscite might, actually, bring Pierluisi and Ricky together.

"No matter how strait the gate, How charged the sentence I am the master of my fate., I am the captain of my soul."
I have had many battles in life - much stronger it most - and all I have overcome. I will win.
I feel lonely, but I know I'm not. I have a lot of love around me, I just have to open up. Again, I open my arms and my heart to my people ... " (sic).

PPD status meeting adjourned - The New Day

Gun shop owners plead guilty to fraud

The owners of a Puerto Rico armory pleaded guilty Monday to federal charges tied a fraud scheme to grant firearms licenses to some 1,300 people.
María del Carmen Rivera Negrón and her husband Julio Colón Santiago owned The Lawman Gun Shop in Bayamón, which was raided by FBI agents in December and has been shuttered for months.
U.S. District Judge Francisco A. Besosa set a sentencing hearing for Dec. 11.
Under a plea deal, federal prosecutors agreed to recommend between five and 12 year behind bars for the convicted couple. They could have faced up to 15 years in prison on charges of falsifying identification documents, five years for falsifying court documents, five years for conspiracy, two years for each identity theft count and 10 years for helping convicted felons get guns and firearms licenses.
Rivera Negrón and Colón Santiago were arrested in mid-March on 490 counts in a scheme in which they charged between $1,000 and $1,500 for each fraudulent transaction. They were allegedly aided in the scheme by notary attorney Antonio M. Peluzzo, who authorities say trolled for customers at The Lawman Gun Shop on PR-2. He was arrested in December and is expected to plead guilty.
The defendants used their direct access to the Police Department’s Bayamón command center to expedite the illegal permits, greasing the wheels with deliveries f donuts, pitorro rum and coffee, according to federal authorities.
The forged judges’ signatures and court documents from judicial centers in Caguas, Humacao, San Juan, Bayamón and Aibonito.
Authorities said Peluzzo trolled for illicit customers at the gun shop, promising to get them licenses to carry firearms without having to show up in court or produce character witnesses. The bogus permits were then given to customers in bars, at the gun shop and shopping centers, authorities said.
“On such a violent island, where murder is rampant, we have 1,000 people or more with firearms acquired with bogus permits,” U.S. Attorney Rosa Emilia Rodríguez said after the raid.

La calle Ernesto Cerra se convirtió en un enorme y colorido canvas como sede de Santurce es Ley, un festival de música, comida y arte urbano que, en su quinto año, ha provocado la atención internacional y catapultado el factor "hip" del barrio capitalino en toda América.

El festival busca reconocer la comunidad artística “underground” del país, además de incentivar el arte colectivo e individual mediante la inyección del mismo en las comunidades.
Cientos de niños, jóvenes y adultos se personaron al lugar para disfrutar de la variada gama de exposiciones artísticas, delicias culinarias, cerveza y música en vivo a lo largo de la calle Cerra y otras aledañas.
El festival fue organizado por artistas, galeristas y miembros de la comunidad que buscan "activar el circuito de arte contemporáneo” en la zona a través de la restauración de murales e instalaciones, así como la presentación de nuevas piezas y exposiciones en varias galerías del área.
Santurce es Ley ha crecido exponencialmente desde su primera edición, hace cinco años. Se estima que sobre 20,000 visitantes en tres días participaron de la actividad, la cual presenta las obras de sobre 100 artistas de diversas disciplinas. Además, de forma virtual, reseñas del festival en The New York Times y otros medios internacionales han llevado la actividad a millones de personas en el mundo.

Entrevista a la Hon. Liana Fiol Matta, Jueza Presidenta del Tribunal Supremo de Puerto Rico

Jueza Presidenta quiere integridad de la judicatura, pero no investiga irregularidades (video)

Fiol Matta más bien se expresó confiada en la evaluación que cada tres años realiza la Comisión de Evaluación Judicial. El proceso consiste en la administración de cuestionarios a abogados y abogadas que han postulado ante el juez o jueza, entrevistas al personal del Tribunal donde trabaja y visitas a la comunidad. Los jueces o juezas que obtengan resultados deficientes, pueden ser referidos por la Jueza Presidenta a la academia judicial para reforzar las destrezas que necesitan, según explicó.  
Sin embargo, a este proceso u otros similares se han sometido tanto el juez superior Manuel Acevedo Hernández, acusado federalmente de recibir sobornos a cambio de favorecer a un acusado de homicidio negligente; como el juez superior Reinaldo Santiago Concepción, quien fue expulsado por un patrón de de abuso físico y psicológico contra su esposa, así como de uso de cocaína. Acevedo Hernández fue evaluado por la comisión en cuatro ocasiones entre los periodos de 2002 a 2011. 
Pese al litigio por corrupción judicial que rodea al juez superior, la Jueza Presidenta no ha sostenido conversaciones sobre el caso con el juez administrador de esa región, ni ha solicitado que se investigue a los siete jueces que se han inhibido o que han absuelto al contador Lutgardo Acevedo López en distintas etapas de un caso previo a la acusación de soborno judicial, cuando en 2010 se le encontró causa probable para arresto por haber amenazado y apuntado con un arma a otro individuo. "El hecho de que otros jueces hayan intervenido en otras etapas o en otros casos con la misma persona, pues no es suficiente para entender que ha habido algún tipo de acción dudosa", defendió la togada de 68 años. Acevedo López es coacusado del juez Acevedo Hernández a nivel federal y ayer NotiCel publicó en primicia que se declararía culpable la semana entrante.
Este diario constató con la Oficina de Administración de Tribunales (OAT) que dos de los juezas que intervinieron con Acevedo López en ese caso previo, tienen quejas pendientes en la Oficina de Asuntos Legales de la OAT. Tanto la Jueza Joann Torres Toucet, en el Tribunal de Primera Instancia, como la Jueza Iris Reyes, del Centro Judicial de Arecibo, tienen querellas bajo investigación. El contenido de las quejas es, sin embargo,  confidencial hasta su adjudicación.   
Durante la entrevista, Fiol Matta recordó que muchas denuncias se dan porque una persona no obtiene la determinación judicial que quería y que creía que era correcta, pero aún así se investigará cada denuncia sin descartar ninguna. "De parte nuestra, puedes estar segura que hay una actitud de cero tolerancia", aseguró.
La también académica, quien fue decana de la Academia Judicial, se expresó apasionada con lograr "una justicia con sensibilidad a las dificultades que tienen algunos ciudadanos". El plan para velar por la integridad de la judicatura se hará, sin embargo, desde la academia al reforzar el currículo. En cuanto al funcionamiento en los tribunales, ha solicitado que se trabaje un plan para la rotación de los jueces para tener una judicatura que "conoce más, de más áreas del derecho". 
Recordó que la integridad de la judicatura depende en, gran medida, de los nombramientos que hagan las otras ramas. No objetó que se busquen alternativas al proceso de nominación para que incluya más participación de la ciudadanía; pero indicó que el poder nominador sólo podía alterarse mediante una consulta constitucional al pueblo. "Ningún sistema es perfecto, así que obviamente el que está vigente tiene sus defectos, y si podemos idear como pueblo uno mejor, pues bienvenido sea", reconoció.
NC: ¿Vendrán más investigaciones en cuanto a los jueces que atendieron casos previos de Lutgardo Acevedo?
LFM: Yo no sé. No tengo conocimiento ninguno, ni ha llegado nada que me indique a mí que esas investigaciones están en proceso o que van a darse.
NC: Pero como son empleados de la rama, usted tiene esa jurisdicción (de hacer investigaciones éticas).
LFM: Cuando juramenté, y creo que con más énfasis cuando hablé frente a la comisión de nombramiento del Senado, dije que había cero tolerancia en cuanto a jueces o juezas que faltaran a su llamado, que incurrieran en conductas antiéticas o peor aún, delictivas. Siempre estamos pendientes de ese aspecto. No tenemos investigadores, fiscales o agentes del Negociado de Investigaciones Especiales (NIE), pero toda queja que se recibe en la OAT se investiga. Queremos una judicatura que sea íntegra. Ahora dicho eso: eso sucede en la OAT. Mi intervención no la hay. Esas quejas se investigan. Si se encuentra fundamento, se someten a la comisión de disciplina judicial en un proceso, que incluye vistas y recibir pruebas de ambas partes, y una vez la comisión hace su recomendación, puede venir ante el Tribunal.
NC: Siempre se ha dicho que (el caso del Juez Acevedo) es un solo caso y que no se puede mancillar la reputación de todos los jueces, pero hay duda legítima porque este individuo (Lutgardo Acevedo), acusado de corrupción judicial, ha tenido tres casos previos donde ha salido absuelto o se han inhibido una cantidad grande de jueces del proceso que se llevaba en su contra.
LFM: Las autoridades que llevan a cabo ese tipo de investigación no han presentado cargos contra esos otros jueces.
NC: Cuando usted habla de la integridad de la judicatura, ¿cómo ve el rol de Tribunales? ¿Debe ser más proactivo en esa investigación, previo a que surjan acusaciones de ese tipo?
LFM: De parte nuestra, puedes estar segura que hay una actitud de cero tolerancia; que cualquier queja o querella que pueda surgir en cuanto a la integridad de algún miembro de la judicatura se investigue y se llegue a las conclusiones que se tienen que llegar. Claro, los procesos que nosotros comenzamos son procesos disciplinarios, procesos éticos, no son procesos criminales. Si percibimos alguna actividad que puede entenderse como delictiva, se refiere entonces al Departamento de Justicia. Pero con relación a lo que te preocupa, que es el caso particular del juez Acevedo, el único juez que está ahora mismo acusado o bajo investigación es el juez Acevedo. El hecho de que otros jueces hayan intervenido en otras etapas o en otros casos con la misma persona, pues no es suficiente para entender que ha habido algún tipo de acción dudosa. 
Igualmente, quiero aprovechar porque tengo que decirlo: nosotros tenemos en la Judicatura 350 Jueces. Son 380 posibilidades, pero siempre hay vacantes. La inmensa mayoría son personas íntegras, dedicadas a esta tarea de adjudicar, que no es una tarea fácil e incluso los expone a riesgos. Yo quisiera que los casos que hay - porque los ha habido, este que has mencionado del juez Acevedo y el que mencionaste antes del juez (Reinaldo Santiago Concepción) que abusaba de su esposa - se entendiera que son la minoría ínfima de personas comparado con el universo de jueces y juezas que tenemos trabajando en los Tribunales.
NC: Y yo lo entiendo así, pero en parte no sabemos hasta que se lleven a cabo las investigaciones.  Esto sale a la luz pública porque la prensa estuvo constantemente cubriendo el caso, entonces surgen dudas del proceso.
LFM: Fíjate que todo es un trabajo en equipo. Cada cual tiene su función: la prensa tiene su función investigativa y también de denunciar las cosas que percibe, el ministerio público tiene su función de investigar, acusar y traer la prueba que los jueces y juezas pueden considerar para tomar las decisiones - porque una vez se está en el Tribunal la decisión tiene que ser a base de la prueba que se trae, no de lo que dijo el periódico o la duda que suscitó. Otros agentes investigadores y la Policía tienen su función. O sea, que todo es un trabajo en equipo. Cierto es que termina en el proceso judicial, pero si ese trabajo en equipo se hizo bien, entonces lo que se decida va a ser lo correcto.
NC: Pero por parte del Tribunal, ¿qué tipo de evaluación deberían hacer para que no ocurran más casos como ese, para que se proteja a los jueces de influencias o se dificulte que éstos puedan influenciar (indebidamente)?
LFM: Creo que lo principal necesariamente es la calidad de las personas nombradas como jueces, y entonces sí, nosotros tenemos que como ente supervisor estar pendiente. Pero pendientes de lo que se nos haga llegar como quejas. No descartarlas y decir que esos son chismes. Todo se investiga y analiza para estar seguros que tenga o no tenga base. He dado instrucciones de que hay que ser bien estrictos para eso. Los jueces administradores de las distintas regiones tienen una función que va más allá de ser meros coordinadores del trabajo judicial, de asegurarse que los casos se asignen correctamente, se trabajen con diligencia. Tienen también la obligación de estar pendientes de estos asuntos en sus regiones. Yo no estoy en las regiones, la directora de Tribunales no está en las regiones; en las regiones están los jueces administradores. 
NC: ¿Qué instrucción le ha dado a esos jueces administradores?
LFM: La instrucción de estar pendientes, de conocer su región, de estar pendiente de cualquier asunto, denuncia o duda que pueda surgir del trabajo de cualquiera en el Tribunal, no tan solo los Jueces. Eso es como parte de un sistema de supervisión que se dirige a la decisión de si hay o no evidencia para sostener la queja. Algunas denuncias se dan por razón de que una persona no obtiene la determinación judicial que quería y que creía que era correcta. Se reciben muchas denuncias que cuando investigamos es porque la persona no obtuvo lo que quiso; pero no podemos ir con la actitud de que ‘no voy a investigar porque probablemente fue esto’. No, siempre alerta y siempre investigamos todo.
NC: Sé que hay un recorte presupuestario, pero, ¿hay instrucciones de reforzar este componente (de investigación)?
LFM: Las instrucciones son que tenemos que trabajar dentro de nuestra realidad presupuestaria. No queremos terminar - como nunca se ha terminado en la rama judicial - con insuficiencia presupuestaria al final del año fiscal. Pero dentro de ese marco, tenemos que redirigir los recursos. No es una directriz de que vamos a cortar tal por ciento a todo. Vamos a ver cuáles son nuestros programas importantes, vamos a ver cómo le podemos dar continuidad dentro de la realidad económica, vamos a establecer prioridades y tratar de no afectar, o afectar lo mínimo posible, ciertas iniciativas y programas, y dentro de estos, lo que acabamos de hablar que todo proceso se conduzca en un marco de integridad.
NC: ¿Ha llamado al juez administrador de la región de Aguadilla para conocer qué problemas de fiscalización deben ser corregidos?
LFM: La Jueza (Sonia Ivette Vélez Colón), directora ejecutiva de la OAT, tuvo algunas comunicaciones en su momento, pero yo me he reunido con todos los jueces en una reunión del Consejo Asesor. Los jueces administradores forman el Consejo Asesor del Juez Presidente. Entonces, ahí nos reunimos cada dos meses. Me reuní con ellos, no para hablar de las especificaciones de Aguadilla, pero sí para oirlos a todos sobre los problemas que tienen en cada reunión, y además para expresarles lo que quiero. Ahora comienzo las visitas a las regiones. 
NC: Los jueces también rinden un informe anualmente, pero, ¿esa revisión se está dando como debe ser o se debe reforzar? Porque vemos, por ejemplo, el caso del juez Acevedo que rindió su informe: ¿fue que mintió o hubo un desliz en esa evaluación?
LFM: Los jueces rinden su informe. El informe se estudia para asegurar que todo esté expuesto. De surgir, una cosa como esa se investigaría, pero cualquier cosa que aparezca que nos lleve a pensar que no se cumplió con la obligación de rendir el informe de manera veraz, habría que investigarlo. Hasta el momento no ha surgido esa situación. Esos informes después se envían a la Oficina de Ética Gubernamental, y la OEG investiga. 
NC: Bien, para recapitular: ¿usted está confiada en que no hay más casos como el del juez Manuel Acevedo?
LFM:   Yo no conozco más casos como el de Manuel Acevedo.
NC: Si no lo está, ¿cree que hay algo que pueda hacer su rama para indagar si hay esa tendencia en otros jueces?
LFM: Estamos, como te dije, alerta. Los jueces administradores tienen instrucciones de estar alerta y la OAT tiene instrucción de estudiar e investigar cualquier cosa que se suscite, no descartarla de saque porque parezca que tiene otras motivaciones.
